Planning Appeal - Imperial Gardens

Evans Jones were appointed following refusal of planning permission to change the use and extend the premises to form a café/bistro/deli.

The property is located within Imperial Gardens, one of Cheltenham’s most prestigious public parks, which is home to the town's world renowned Food, Jazz, Literature and Science Festivals.

Planning Committee members determined that the proposal would; “cause harm to the quaint and distinctive character of this important local building… and cause harm to the amenity of the park users”

Evans Jones, acting as Planning Consultants, successfully appealed the decision and was awarded full costs against the local authority.

The appeal inspector in determining the costs application stated that “…..no robust assessment of the implications of the use has been made…..Accordingly, the Council’s refusal of the application amounts to unreasonable behaviour and has caused the appellant the unnecessary expense of having to appeal.”
