The best prepared application can on occasions be refused consent. Planning requires those making decisions to weigh in the balance many competing issues, including: Local / Structure plan policy; LDF’s UDP; Regional Policy Guidance; National policy statements, together with precedents laid down by appeal inspectors and emerging law / interpretation laid down by the courts.

Occasionally planning decisions are made as a result of local opposition to an otherwise sound proposal. Where Councillors make the final decision in planning or development control committees, individual councillors can have a direct impact upon the outcome of a planning application, this can be both positive and negative depending upon the Councillor’s agenda.

When applications are refused consent it is imperative that a full analysis be made of the issues and primary considerations which led to the refusal of consent. Following this exercise it is possible for the planning team to make an accurate assessment of the chances of success at appeal.

An appeal against the refusal of planning or listed building consent takes one of three formats:

  1. Written representation
  2. Informal hearing
  3. Public Inquiry

The choice of appeal format is dependant upon the reasons for refusal, degree of public interest, complexity of the case, developer’s timescale and budget.

The planning team at Evans Jones comprise both Chartered Town Planners and Chartered Surveyors. The practice deals with 20-30 appeals per annum, ranging from written representation appeals through to hearings and complex public inquiries.
