<description><![CDATA[I am proposing to apply for the renewal of an extant planning permission. In the procedures it is clear that plans and design and access statements are not required with the application but in a case where the Council has introduced new policies since the grant of the original permission does the Council have the right to ask for additional information before validation. 

I have a situation where all the developer is proposing is to renew the permission, nothing else will change. The Council is seeking an'energy report' waste 'disposal strategy' and a 'sustainable urban drainage system' the requirement of which seems to miss the point that it is only the time limit condition which being changed.

The question you asks seems simple but may be very complicated.

Please bear in mind that, without having any details of the property I really can only advise on principles thus my comments should be taken in this light.

Regulations that are likely to apply to your home are the Building Regulations. However they do apply retrospectively so would only have been relevant at the time of construction or possibly conversion.

Ideally there would be an accessible means of egress to front and rear but if the main hallway is suitably protected and gives direct access to the final exit then risks may be minimal.

I would suggest that you get some good smoke detection in place preferably mains powered.

In all likelihood no regs are likely to apply.

The DDA does not really require your landlord to do much in this circumstance although if your landlord is an Housing Association or other public body you could try and make a case to them under their Disability Equality Duty.

<description><![CDATA[I dont quite understand what the above article post regarding permitted development rights has with regard to \'replacement dwellings\' specifically BUT the new legislation for PD on October 1st 2008 has caused much confusion & inconsistent interpretations by many councils, home owners and building design professionals alike. 
Our web site permitteddevelopment.org seeks to explain and explore the issues and how it can be utilised for development potential of a residential dwelling.
Quite frankly it is a mine field where only the lawyers will win in the end and the Planners will still be overloaded with Certificate of Lawful Development applications rather than Planning applications from confused home owners seeking clarification.
Certain government legislators need to live at the sharp end of the planning system for a while before they put pen to paper that will affect all our lives in the end.]]></description>

Please, please don't even consider replacing this beautiful building with something modern.  It is NOT in a bad state and the shop fronts below could easily be replaced.  And who would not want to live in a beautiful building like this.  SYMPATHETIC RESTORATION is the best route.  Gloucester needs to preserve its history, not destroy it.
