Renewal of Planning Permission - Revised Fees

Application for New Planning Permission to Replace an Extant Planning Permission - Revised Fee Schedule

Following the implementation of the Government’s revised procedure for the renewal of planning permission (Extension of time applications) the Government have now at last released the long promised revised fees for applications and deemed applications.

For all applications for a new planning permission to replace an extant planning permission, fixed fees now apply dependent upon the development proposed.

In brief these are as follows:-

Householder Application - £50.00
Major Development Proposal - £500.00
In all other cases - £170.00

For the purpose of the fee regulations, major applications are deemed to be proposals for commercial development of 1,000m2 or more, or in the case of residential development, developments of 10 or more residential units.

These revised regulations are a welcome incentive for developers and landowners which should help to keep extant consents alive without being subject to the punitive cost of fees equivalent to a new full application.

For example, under the original fee regulations an application for renewal of consent for a 20 unit residential scheme would have incurred a fee of £6,700, but now under the revised provisions the same application would incur a flat rate fee of £500.00.

Obviously the benefit to developers increases as the number of units proposed increases, however, in practice any development, whether it be a single dwelling or multi unit scheme, will benefit from this revised fee structure.

Under the new regulations applicants do not need to re-submit plans or Design and Access Statements and thus any developer or landowner sitting upon a site with an extant consent is well advised to seek renewal of that consent at the appropriate time.

In all cases it is advisable to submit a renewal application well before the cut off date for the original consent to ensure that landowners and developers have sufficient time to make a material start on the development should the Local Authority decide not to permit the renewal application.

I am proposing to apply for the renewal of an extant planning permission. In the procedures it is clear that plans and design and access statements are not required with the application but in a case where the Council has introduced new policies since the grant of the original permission does the Council have the right to ask for additional information before validation.

I have a situation where all the developer is proposing is to renew the permission, nothing else will change. The Council is seeking an'energy report' waste 'disposal strategy' and a 'sustainable urban drainage system' the requirement of which seems to miss the point that it is only the time limit condition which being changed.

I would appreciate your comment.
