Evans Jones LLP secure consent at appeal for retention of unauthorised shop front.
Acting on behalf of Hammonds Furniture Ltd (Hammonds Web Site) Evans Jones LLP have secured consent for the company to retain a shop front and fascia which had been inadvertently erected without local authority approval.
Following the local authority's threat of enforcement action, an application was submitted by the company to retain the shop front as erected.
The Local Authority refused consent on the grounds that the new shop front failed to retain the character of the building.
The appeal inspector determining the planning appeal lodged by Evans Jones LLP in granting consent confirmed that
the proposal would have a simple design, with some decorative moulding, and I consider that it would raise the quality of shop front design in the parade

This is a classic case of a local authority seeking to impose design standards which are not supported by policy. It is a shame in the current economic climate, with so many small shops closing that Cheltenham Borough Council failed to support a proposal which brought back into use a vacant shop and improved the visual appearance of the shopping parade.
