It has been reported that the much discussed Community Infrastructure Levy (CIL) will undergo further consultation. It is unlikely that the CIL provisions will take effect until October 2009 at the earliest.
The Planning Act 2008, which was passed at the end of November, provides the primary legislation for CIL however the precise mechanics behind the CIL and how such financial contributions will differ from Section 106 Contributions are yet to be decided upon.
The Department for Communities and Local Government (CLG) has confirmed that due to the current economic downturn more time is needed to consider the wider effects of secondary legislation and subsequent impacts on the economy.
David Jones, Partner in charge of Planning commented:
“This apparent cautious approach shows that policy makers are considering the wider implications and potential barriers to bringing development sites forward and not just the end financial gain”.
The CIL will eventually need to be integrated into development plan documents at the local level which may take further time. Adoption at the local level will also need to clearly set out the need for community infrastructure improvements in order that they can be challenged if necessary.
